Terms of Service

1. Acceptance of Terms

By accessing or using the Rebirth API service ("Service"), operated by Rebirth API ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Rebirth API provides business intelligence APIs including business lookup, website audits, lead enrichment, review response generation, and SMS generation. The Service is accessed via API keys issued through your account dashboard.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are fully responsible for all activities that occur under your account.

4. API Usage & Rate Limits

  • API keys are for your use only and must not be shared or published publicly.
  • You agree to abide by the rate limits associated with your plan. Exceeding rate limits may result in temporary throttling or suspension.
  • You may not use the Service to scrape, harvest, or collect data in violation of any applicable laws or third-party terms of service.
  • Automated abuse, including creating multiple free accounts to circumvent limits, is prohibited.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Send unsolicited communications (spam) using data obtained through the Service.
  • Attempt to reverse-engineer, decompile, or hack the Service.
  • Interfere with the Service's infrastructure or other users' access.
  • Resell or redistribute API responses without authorization.

6. Pricing & Payments

  • Paid plans are billed monthly via Stripe. Prices are in USD and do not include applicable taxes.
  • You may upgrade, downgrade, or cancel your plan at any time. Downgrades take effect at the end of the current billing cycle.
  • We reserve the right to change pricing with 30 days' notice via email.
  • Failed payments may result in service suspension until payment is resolved.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We log API usage (endpoint, status code, latency) for analytics and billing. We do not store the content of your API requests or responses beyond what is necessary for service operation.

8. Intellectual Property

The Service, its APIs, documentation, and website are the property of Rebirth API and protected by intellectual property laws. You retain ownership of any data you submit through the Service. We retain no rights to your input data.

9. Service Availability & SLA

  • We strive for 99.9% uptime but do not guarantee uninterrupted service.
  • Scale plan customers may be eligible for SLA credits — contact us for details.
  • We reserve the right to perform maintenance with reasonable notice when possible.

10. Limitation of Liability

To the maximum extent permitted by law, Rebirth API shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant the accuracy, completeness, or reliability of any data returned by the API.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your API keys will be deactivated and your data will be deleted within 30 days.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
